Prime Skill LOGIC is built around a different sequence from an ordinary slot. Texas Penal Code Chapter 47 (opens in new tab) defines a bet, lottery, gambling device and thing of value. Section 47.01(4) reaches electronic devices where an award is determined solely or partially by chance, even when some skill is present.
In City of Fort Worth v. Rylie (opens in new tab), the court held that the eight-liners before it were lotteries. Those operators stipulated that their machines were played solely or predominantly by chance and that the player did not control the odds. Prime does not rely on those facts and does not use the limited merchandise exception as its Texas position.

Attorney General opinion KP-0520
The Texas Attorney General's KP-0520 opinion (opens in new tab) addresses a machine with a primary slot-style mode that could award value through a random symbol arrangement and a later memory recovery mode. The opinion says later skill does not cure a primary award in which chance participates. Prime's documented distinction is that the individual paid Play result is fixed, inspectable and avoidable before commitment. KP-0520 is advisory, not a court judgment about Prime.

Seizure and proof burden
Texas Code of Criminal Procedure Article 18.18 (opens in new tab) also matters operationally. When a machine is seized and a show-cause process follows, the claimant can bear the burden of proving the machine is not a gambling device. Why does precommit inspection matter?
Texas defines a gambling device by asking whether chance determines the award solely or partially. Prime's position is that a freely inspectable, fixed and avoidable result does not make the individual paid Play depend on chance. The formula and choice must be real in operation, not merely described in marketing.
Does a skill feature after a loss solve the Texas issue?
