Why the legal distinction matters in North Carolina

North Carolina has two separate classification paths that matter here.

The second path is more direct for a cash-redeemable machine. G.S. 14-306 (opens in new tab) reaches paid activation when a user may receive money, credit, an allowance or another thing of value. Its amusement exceptions do not permit a cash payout. G.S. 14-304 (opens in new tab) also reaches manufacture, ownership, storage, sale, lease, transport, placement and maintenance of a prohibited device.

The first asks whether a player is betting value in a game of chance. G.S. 14-292 (opens in new tab) supplies that general rule. The North Carolina Supreme Court applies a whole-game predominant-factor analysis in cases such as Gift Surplus, LLC v. State ex rel. Cooper (opens in new tab).

That means a venue cannot stop at the statement that skill matters. It must examine the payment, credit and redemption structure as well as the individual player decision.

What North Carolina law says

Paid device and redemption rule

G.S. 14-306 (opens in new tab) defines prohibited slot devices broadly. The material text reaches a machine activated by payment or value when the user can receive or become entitled to money, credit, an allowance, a thing of value, an exchangeable record or additional use. The narrow skill and amusement exceptions either prohibit cash and redeemable value or impose strict replay and merchandise limits. Cash payout defeats the exception.

The North Carolina Attorney General's official Video Poker Machines opinion (opens in new tab) explains that skill alone does not create the exemption. Every condition must be satisfied.

General gambling rule

G.S. 14-292 (opens in new tab) prohibits operating, playing or betting in a game of chance at which money, property or another thing of value is bet, subject to express statutory exceptions.

Prime's documented position is that chance does not determine whether an award is granted in the exact Prime Skill LOGIC system. That position addresses the chance element. It does not answer every device provision.

Predetermined systems and entertaining displays

G.S. 14-306.4 (opens in new tab) addresses electronic sweepstakes conducted through entertaining displays. It expressly reaches finite predetermined pools and predetermined entries. Prime is not presented as a sweepstakes, but the statute shows that predetermination by itself is not a North Carolina safe harbor.

The published Court of Appeals decision in No Limit Games, LLC v. Sheriff of Robeson County (opens in new tab) reached the same adverse boundary at the preliminary-injunction stage. A predetermined-entry system with reveal, nudge and a post-loss memory game did not establish likely success.

Seizure and venue consequences

G.S. 14-298 and 14-299 (opens in new tab) authorize seizure and court disposition of illegal gaming items, money and related property. G.S. 18B-1005 (opens in new tab) separately prohibits an ABC permittee or its employees from knowingly allowing gambling violations or other unlawful acts on licensed premises.

Official 2025 and 2026 ALE releases document complaint-driven investigations, search warrants, gaming-equipment seizures and cash seizures. Those releases are enforcement facts, not Prime-specific adjudications.

Why Prime Skill LOGIC is materially different

Prime's chance analysis focuses on the sequence before the individual paid Play.

That is a serious, fact-specific position under the chance analysis in G.S. 14-292 and the published appellate cases. It is not confirmed North Carolina law. It also does not eliminate G.S. 14-306's separate paid-device and redemption text.

Hard facts we do not hide

Prime Skill LOGIC accepts cash, uses credits and paid stakes, supports redeemable value and venue payout, and uses reels, slot-like themes, jackpots and feature presentation. Those facts increase device-classification and enforcement risk in North Carolina.

Venue and operator business value

A premium venue review should expose the real record before money or equipment moves. Prime can provide a version-controlled mechanics trace, a defined commitment point, AUTO_START OFF, build identity, event logs, payment and payout mapping, servicing roles and an incident protocol.
