THE QUESTION
Prime is not asking a venue to rely on the label skill. The Kansas question is whether consideration leads to an opportunity for a prize whose award is determined by chance, and whether the device falls within a chance-based gambling-device definition. The core statutory framework is set out in K.S.A. 21-6403.
That makes the individual paid Play the critical point of analysis. Prime's documented position is that chance does not determine whether the award is granted in the exact system. The result for that Play is fixed, available to be identified through the information and calculation path, and avoidable before commitment. Prime presents that as a fact-specific, defensible interpretation of Kansas law, not as confirmed Kansas law.
The opposing legal theory may treat an upstream list-construction event, stake deduction or list consumption as the legally relevant chance event, and may characterize skill as only revealing, selecting or avoiding a result. OFFICIAL SOURCES
Article 15, Section 3 of the Kansas Constitution provides that lotteries and the sale of lottery tickets are forever prohibited, subject to the constitutional exceptions described in the same Article. This is the constitutional starting point. It does not decide whether the exact Prime system satisfies or falls outside the statutory chance element.
K.S.A. 21-6403 defines a bet as a bargain dependent on chance in which someone stands to win or lose value. It defines a lottery as an enterprise in which, for consideration, participants receive an opportunity to win a prize whose award is determined by chance. It also defines consideration, gambling device and gambling place. The statute includes a bona fide contest exclusion for prizes to actual contestants in a genuine contest for skill, speed, strength or endurance, but the fit between that exclusion and a cash-in, redeemable electronic device remains a fact-specific legal question.
The same statute contains a serious adverse boundary. A reel or slot-like device, and other electronic devices primarily designed for gambling, can fall within the gambling-device definition when operation may deliver or entitle a person to money or property as a result of chance. The statute also says that automatic payment by the device is not required. Prime's argument therefore has to address chance at award determination, not merely the existence of player interaction.
K.S.A. 21-6406 reaches knowing commercial conduct such as operating or receiving earnings from a gambling place, conducting a lottery, setting up or collecting proceeds from a gambling device, and allowing a place to be used as a gambling place. K.S.A. 21-6407 addresses manufacturing, distributing or possessing with intent to distribute a gambling device or essential part. The venue, distributor, servicer and operator therefore need the same exact-mechanics record as Prime.
K.S.A. 74-8702 defines a lottery machine as a machine that accepts consideration and may deliver a prize or evidence of a prize as the result of an element of chance, regardless of the skill required. The definition expressly includes a machine in which the prize is determined by both chance and the purchaser's skill. This is not a Prime-specific ruling, but it is the strongest statutory text a regulator can use against a mixed-mechanics argument.
In Three Kings Holdings, L.L.C. v. Six PDF, the Kansas Court of Appeals held that the Kandu Challenge card game was a lottery under the facts in that record. The opinion used a dominant-factor analysis, treated the relevant game unit as a single hand, and affirmed findings that card distribution and the cut dominated the result even though players used memory and strategic decisions. The opinion is important authority, but it decided a card game with chance events that remained operative inside the hand. It did not decide the Prime Skill LOGIC mechanics.
The Kansas Racing and Gaming Commission's illegal-gambling guidance describes the KRGC as a coordinating agency for most illegal-gambling complaints and says its role includes educational, administrative and law-enforcement methods. The KRGC states that enforcement focuses on illegal poker rooms and illegal slot machines and is carried out primarily through civil asset seizure and forfeiture proceedings and coordination with local law enforcement. Its current illegal-gambling FAQ warns that a paid, slot-like machine offering a chance to win cash or redeemable value is probably an illegal gambling device. The 2025 KRGC Annual Report PDF reports 1,348 illegal gambling-machine seizures from 2013 through 2025, including 80 in calendar year 2025.

THE DECISION PATH
Prime's argument is not that a player can press a button or perform a calculation after a machine has already determined an unknown prize. The claimed distinction is the complete sequence before the individual paid Play.
Each game and stake has its own 1,000-result list. The positions persist when the player changes games or stakes.
Future result information can be inspected without paying for the results inspected.
Info/? presents the relevant information, and X = A/B − C identifies the next relevant list position or result.
Before the individual Play, the player can continue inspecting, change the game or stake, decline or avoid the identified result, or use Payout to reset the local session and later begin a new session.
The individual result is fixed before that Play and does not change after commitment. AUTO_START OFF preserves a manual decision point instead of automatically executing selected future Plays.
These facts matter because they target the causal link in the Kansas statutes. Prime's position is that a list-construction process upstream of the paid Play is not the event that determines whether the prize is awarded when the individual result is already fixed, identifiable and avoidable before commitment. The State may argue that the upstream process remains legally decisive. That is the live legal issue, and it must be tested on the actual device record.

That limitation does not change Prime's product position on award determination, but it matters to how Kansas evaluates the complete transaction and the role of skill.
CURRENT STATUS
Prime Skill has no Kansas-specific binding determination, license, clearance or state approval.
