Florida applies broad restrictions to slot devices

Florida Statutes §849.16 (opens in new tab) defines covered devices broadly, including systems activated by money, accounts, codes or other inputs that can award money, credit, value or additional play through skill, chance or an unpredictable outcome. A narrow amusement route

Florida Statutes §546.10 (opens in new tab) permits defined family amusement games only when the player controls the outcome through skill and no material element of chance is inherent. Casino simulations and slot reel presentation are excluded. Type A awards no thing of value. Type B permits only qualifying merchandise onsite and within statutory limits. Cash, gift cards, alcohol, tobacco and side cash conversion remain outside that route.

Licensed gaming remains tied to specific facilities

Nontribal slots are confined to qualifying licensed operations at specific facilities in Miami Dade and Broward. Tribal gaming depends on federal law, Indian lands and compact authorization. Venues can face consequences beyond gaming enforcement

A bar can face consequences for its beverage license in addition to gambling enforcement under Florida Statutes §561.29 (opens in new tab). Unsupported claims such as “state approved,” “licensed skill game” or “legal in Florida” also create a separate risk under deceptive practices law.

Florida market reality

Machines already operating in Florida do not establish a lawful market

Florida machines are visibly present in bars, gas stations, convenience stores, adult arcades, restaurants and disguised storefronts. Public enforcement records do not show a general lawful channel for skill machines in bars or gas stations. They show a mix of licensed casino facilities, genuine amusement games, older advance disclosure and sweepstakes theories, and an active gray market that can remain in place until investigation and seizure.

The current enforcement trend is not passive. Florida authorities reported 525 machines seized across 39 sites in four counties in February 2026. By June 10, 2026, the Attorney General and Florida Gaming Control Commission reported 3,114 machines seized, $1.7 million taken and 81 arrests since the start of the year; one Lee/Collier operation accounted for 479 machines and $294,150. An arrest or agency label is not a final adjudication, but the scale shows real operational exposure. A tax sticker, business license, attorney letter, “skill” label, “bingo” label, free entry route or months of uninterrupted operation does not amount to Florida gaming authorization.

Florida's sweepstakes rules require more than the words “no purchase necessary”

Florida Statutes §849.094 (opens in new tab) allows limited, occasional game promotions connected with bona fide consumer products or services. A lawful promotion cannot require an entry fee, payment or proof of purchase as a condition of entry. Promotions offering more than $5,000 in announced prizes require advance filing and prize security, subject to the statute.

Compliance with the promotion rules is expressly not a defense to a slot-device charge. Florida Attorney General opinions rejected phone card and Internet time models in which the product was incidental, predetermined entries were revealed through a machine and cash prizes drove the customer flow. In August 2026, Florida filed civil actions alleging that Stake and VGW-related platforms used dual currencies and a sweepstakes label to disguise real-money online casino play. Prime will not use a product wrapper, a false free entry path, dual currency, a finite pool reveal or promotional filing to defend the current cabinet. A Florida sweepstakes, if used at all, should be a separate brand promotion with a fixed period, free entry, independent administration and no shared wallet, cabinet reveal, paid Play entry or prize credit.

The venue changes the analysis without supplying its own gaming authority

Bars and alcohol premises

A beverage license adds suspension, revocation and nuisance exposure. The current cash and redeemable build should not be piloted at a site licensed to sell alcohol.

Gas stations and convenience stores

These businesses do not receive gaming authority from their ordinary license. A generic store is not automatically a qualifying Chapter 546 Type B location.

Family amusement and qualifying venues

A Chapter 546 Type B path depends on the exact venue category, skill through which the player controls the outcome, presentation without casino imagery, lawful merchandise, value caps, registration and the absence of cash conversion.

Licensed pari mutuel or tribal facilities

Authorization is specific to the facility, regulator, equipment and agreement. Another venue cannot borrow, imply or move that authority offsite.
