Section 65 prohibits lotteries and schemes in the nature of lotteries. Alabama follows a rule under which adding some skill does not save a game if chance still predominates in determining the outcome.

Prime Skill LOGIC in Alabama
Prime Skill LOGIC does not use chance to determine whether an award is granted. For each paid Play in the exact reviewed system, the result is fixed beforehand, can be identified for free before the player commits, and can be avoided by choosing another game or stake, declining to Play, or requesting payout.
Operation in an ordinary commercial venue is on HOLD. This is a legal-risk classification, not a statement that chance determines Prime Skill awards. Alabama has not approved Prime Skill, and this page does not claim approval or universal legality.

The open issue is narrow but serious. Alabama courts assess the complete economic and technical system, including when consideration is paid, when a result is assigned, what the player knows before committing value, and whether the device resembles a slot-style operation. No reviewed Alabama appellate decision addresses Prime Skill's exact free pre-Play identification and avoidance mechanics.

Real choice before commitment
The player may inspect the result, switch to another game or stake, decline to Play, or request payout.

If the player chooses Play, the previously identified result is consumed. The result does not change after commitment.

Persistent positions
Inspecting or leaving another game or stake does not consume its next result. Its position remains available for later inspection.

Payout and reset
The player may request payout instead of committing to another Play. A completed payout to zero ends the session before a new funded session begins.

Skill recovery
The Extra Game provides a timed 9 by 10 skill grid through which the player can recover value by performance. It does not replace the pre-Play identification and choice controls.

The product distinction is material, but it does not itself create Alabama approval. Alabama may still examine cash insertion, redeemable credits, the integrated system, visual presentation, operator controls, and the exact moment at which consideration is legally committed.
THE CLOSEST ALABAMA PRECEDENT
Barber turned on an unknown assignment revealed after purchase
In Barber v. Jefferson County Racing Association, the Alabama Supreme Court reviewed MegaSweeps as a complete network. Sweepstakes outcomes were predetermined, but customers did not know which outcomes they had received before purchase. Customers learned the results later through slot-style readers. The court held that the integrated operation used illegal slot machines.
Prime Skill's strongest distinction is the timing of knowledge and choice. In the exact Prime Skill system, the player can identify and avoid the next individual result before paying for that Play.
That distinction has not yet been decided by an Alabama appellate court.

COUNTY BINGO AMENDMENTS
County bingo amendments are not a Prime Skill route
Some Alabama local constitutional amendments permit qualifying nonprofit organizations to conduct traditional bingo in specific counties or municipalities. Alabama Supreme Court decisions repeatedly hold that those local provisions do not create a general route for slot-style electronic machines.
Prime Skill is not presented as bingo. A county bingo amendment, municipal business license, local permit, tax payment, or venue agreement does not create statewide authorization for Prime Skill.

ENFORCEMENT REALITY
Enforcement can begin before a final classification judgment
Alabama enforcement is active and can begin before a final classification judgment. The State has used search warrants, device and cash seizures, public-nuisance actions, temporary restraining orders, permanent injunctions, sealed premises, asset freezes, and restrictions on financial transactions.

VENUE AND OPERATOR RESPONSIBILITIES
No Alabama venue should treat this page as permission to place or operate a machine

A fixed rental fee does not eliminate legal exposure if a venue knowingly permits an unlawful device. Revenue sharing creates additional risk because it connects the parties to proceeds.
An alcohol-licensed premises adds separate license and premises risk. The core gambling analysis does not become more favorable because a venue sells alcohol or does not sell alcohol.

Is Prime Skill legal to operate in Alabama today?
No operational approval is claimed. The current Prime Skill status for cash-redeemable operation in an ordinary Alabama commercial venue is HOLD.
Does Prime Skill use chance to decide whether an award is granted?
No. In the exact Prime/Core system, chance does not determine whether an award is granted. The next individual result is fixed, can be identified for free before that paid Play, and can be avoided.
Why is the status HOLD if chance does not determine the award?
Alabama courts examine more than the product's award mechanism. They may examine when cash becomes legal consideration, when a list is assigned, whether the player actually reviews each next result, the integrated network, visual presentation, credits, payout, and operator controls. No binding Alabama decision addresses all exact Prime Skill facts.
Is a predetermined result enough?
Not by itself. Barber involved predetermined sweepstakes results and still found illegal slot machines because customers did not know their assignments before purchase. Prime's distinction is free knowledge and avoidance before each paid Play, but that exact distinction remains undecided in Alabama.
Can a local business license or county bingo amendment authorize Prime Skill?
No general authorization follows from either. Local bingo amendments are narrow exceptions for qualifying traditional bingo. Business, tax, zoning, or venue permissions do not override state gambling law.
Does the NFA report mean Alabama approved the system?
No. NFA supplied technical evidence for a defined version set. It is not an Alabama agency and did not issue a state license or legal approval.
What is the Alabama candidate setting for AUTO_START?
OFF. AUTO_START ON is not an Alabama candidate because it weakens or removes the separate pre-Play inspection and choice that support Prime Skill's strongest distinction.
Can the player request payout instead of another Play?
That is a core part of the exact mechanism. The player can decline the next Play and request payout before committing to it. Exact production behavior still requires build-level verification.
